Fence Installation

Do You Need a Permit to Build a Fence in Kansas City, MO?

In Kansas City, Missouri, a fence does not need a building permit, but it still has to follow zoning height limits and a few firm restrictions. Here is what to check before you build.

In Kansas City, Missouri, a fence does not require a building permit, according to the city’s Information Bulletin No. 129 (revised November 2025). Your fence still has to meet zoning rules, though, and the biggest one is height: 4 feet in the front and street-side yard, and 6 feet in the side and rear yard.

That is the short answer for homeowners inside Kansas City, Missouri city limits. If you live in a suburb or across the state line, your city has its own rules, so confirm with your local planning office before you order materials.

What are the fence height limits in Kansas City, MO?

The city’s bulletin lists these maximum heights for residential properties:

  • Front yard: 4 feet
  • Street side yard (a corner lot’s side that faces a street): 4 feet
  • Side yard: 6 feet
  • Rear yard: 6 feet

If you want a full 6-foot privacy fence, plan it for the side and rear yard. On a corner lot, the side facing the street counts as a street side yard, so that run is held to 4 feet.

What is not allowed?

  • Electric fences. They are not permitted on residentially zoned properties.
  • Barbed wire. In residential zones, barbed wire and other materials likely to snag, cut or injure people are declared a nuisance.
  • Building into the public right-of-way. A fence may not extend into the street right-of-way, which often sits farther back than people expect. Check your survey or plat before you set posts.

Do pool fences have different rules?

Yes. For pools deeper than 2 feet, the city requires an enclosure at least 4 feet high with self-closing, lockable gates when no responsible person is supervising. Plan the gate hardware as carefully as the fence itself.

Do retaining walls need a permit?

Retaining walls of 4 feet or less, measured from grade on the low side, are exempt from a building permit. The exemption does not apply if the wall supports a surcharge, holds back flammable liquids, or sits next to a public right-of-way. If your fence sits on top of a retaining wall, ask the city how the two are measured together.

What should you check before you build?

  1. Your HOA rules. A homeowners association can be stricter than the city on height, materials and color. See our guide to checking your HOA’s fence rules before you build.
  2. Your property line. Use a survey or plat so the fence lands on your side.
  3. Underground utilities. Call 811 before anyone digs post holes.
  4. Zoning questions. The City’s Code Questions team can answer edge cases at codequestions@kcmo.org.
